Arvatz Academy - Terms of Service

Welcome to Arvatz Academy! By signing up for or using our coaching services, you agree to be bound by the following Terms of Service. Please read these terms carefully before using our services.

1. Services Provided

1.1 Coaching Services
We provide online coaching and one-on-one coaching services tailored to your fitness goals. Services include personalized workout plans, video analysis, ongoing feedback, and general coaching support.

1.2 Packages and Subscriptions

  • Online Coaching: Weekly subscription.

  • 1:1 Coaching: Packages available for personal coaching sessions.

1.3 Eligibility
There are no restrictions based on age, fitness level, or geographic location for joining our services.

2. Payment and Billing

2.1 Payment Methods
We accept payment via card, processed securely through Stripe.

2.2 Subscription and Fees

  • Online Coaching: Weekly subscription, charged every week.

  • 1:1 Coaching: Paid in full for selected coaching packages.

2.3 Refund Policy

  • 14-day Refund Guarantee: If you are not satisfied, you may request a refund within the first 14 days of joining online coaching, provided the complementary tripod is returned.

  • After this period, no refunds will be issued, but we will ensure you receive the value of the coaching services you've paid for.

2.4 Cancellation
For online coaching, you can cancel your subscription after the first two weeks for a refund, provided the tripod is returned. For 1:1 coaching, termination is possible within the first 2 weeks of the program.

3. Medical/Health Disclaimer

3.1 Acknowledgement of Risk

By participating in the coaching program, you acknowledge and accept the inherent risks of physical activity, including the possibility of injury. You agree to the following:

  • Personal Responsibility: You are responsible for your own participation and ensuring you are physically capable of engaging in the exercises. If you have any doubts or concerns about your health or fitness level, you are encouraged to consult with a healthcare professional before beginning any fitness program.

  • Consultation with Healthcare Provider: If you have any pre-existing medical conditions, injuries, or concerns, it’s important to consult with your doctor or another healthcare professional before starting the program. Please inform Arvatz Academy of any relevant medical conditions that may affect your ability to safely engage in the exercises.

  • Release of Liability: While Arvatz Academy is here to guide you through every step of the program, you agree to release and hold harmless Arvatz Academy from any claims, injuries, or health issues that may occur as a result of participating in the coaching sessions.

  • Safety First: Arvatz Academy is committed to providing clear instructions to ensure your safety throughout the program. You agree to follow these instructions, perform exercises within your capability, and stop any activity that causes discomfort or pain.

  • Acknowledgement of Medical Disclaimer: You acknowledge that you have read, understood, and agree to the terms of the Medical Disclaimer, which outlines the potential risks associated with the coaching program. You agree that your participation in the program is contingent upon your acceptance of this disclaimer, and you will not hold Arvatz Academy liable for any health-related issues arising from participation.

3.2 Not Medical Advice

The coaching services provided by Arvatz Academy are designed to support your fitness goals and are not intended to replace professional medical advice. You agree to seek professional medical advice if you have health concerns. The coaching services and advice provided are solely for fitness purposes and should not be considered a substitute for medical diagnosis, treatment, or care.

4. Client Responsibilities

4.1 Accurate Information
You agree to provide accurate and complete information regarding your health and fitness status.

4.2 Progress Tracking
You agree to submit regular progress photos and videos for feedback and analysis.

4.3 Communication
You will maintain daily communication and follow instructions provided by your coach to ensure progress.

5. Cancellation and Termination

5.1 Cancellation Policy

  • Online coaching: You can cancel within the first two weeks for a full refund, provided the tripod is returned.

  • 1:1 Coaching: You may terminate your participation within the first 2 weeks. If you choose to do so, you will receive a refund for any remaining, uncompleted sessions.

5.2 Pausing or Transferring Sessions
Sessions or subscriptions cannot be transferred to others. You may pause your subscription for £10 per month.

5.3 Termination by Us
We reserve the right to terminate services if:

  • You fail to make payments after 2 missed subscription payments.

    •   Inappropriate behaviour or conduct is exhibited, including but not limited to abusive language or violation of the community standards associated with Arvatz Academy.
5.4 Session Cancellations
For all 1:1 coaching sessions, you must cancel at least 12 hours prior to the scheduled session. If you cancel with less than 12 hours' notice or do not show up, the session will be charged in full and deducted from your package, regardless of attendance.

6. Privacy and Data Use

6.1 Data Collected
We collect health details, contact information, and payment details for the purpose of providing our services.

6.2 Data Storage and Protection

  • Payment information is securely stored through Stripe.

  • Health and contact details are kept on our secure database.

6.3 Third-Party Sharing
We do not share your personal data with any third parties, except for payment processing via Stripe.

7. Liability and Legal Protection

7.1 Limitation of Liability
Arvatz Academy will not be held responsible for any injuries, accidents, or dissatisfaction that may occur as a result of participating in the coaching program. Participation is at your own risk.

7.2 Dispute Resolution
In the event of a dispute, both parties agree to resolve the issue in accordance with English law, in the courts of England and Wales.

7.3 Governing Law
These Terms of Service shall be governed by the laws of England and Wales, without regard to conflict of law principles.

8. Amendments to Terms

8.1 Changes to Terms
We reserve the right to update or modify these Terms at any time. Any changes will be communicated via email, and you will be bound by the updated Terms if you continue to use our services after such changes.

9. Code of Conduct

9.1 Expected Behaviour
You agree to:

  • Treat others with respect and dignity.

  • Refrain from any abusive, discriminatory, or inappropriate language or behavior.

  • Follow the guidelines and coaching instructions provided.

9.2 Termination for Misconduct
Any violation of these conduct guidelines may result in the termination of your coaching services without a refund.

10. Intellectual Property & Content Usage

10.1 Ownership
All content provided by Arvatz Academy — including but not limited to videos, workout programs, documents, guides, and coaching materials — is the exclusive property of Arvatz Academy and is protected under copyright and intellectual property laws.

10.2 Restricted Access
Content, including video playlists, is provided solely for the personal, non-commercial use of the paying client. You are granted limited, non-transferable access to this material for the duration of your coaching.

10.3 Prohibited Actions
You agree not to:

  • Download, record, copy, or redistribute any of the coaching content or videos

  • Share playlist links or content with non-clients

  • Upload, repost, or use any materials for personal or commercial gain outside of Arvatz Academy

  • Use any screen recording software or tools to replicate content in any form

10.4 Enforcement
Violations of this section may result in immediate termination of services without refund and may lead to legal action.
